By accessing or using Nailzy, you agree to these Terms.

1. Platform Overview

Nailzy is a technology platform that provides:

• online marketplace services for beauty-related products,

• appointment booking tools,

• salon business management software,

• customer communication tools,

• and related commerce infrastructure.

Nailzy itself does not provide nail services, cosmetology services, or professional beauty services. Independent salons, nail technicians, brands, and marketplace sellers operate their own businesses through the platform.

2. Eligibility

You must be at least 18 years old to use Nailzy as a salon owner, seller, or service provider.

By using Nailzy, you represent that:

• the information you provide is accurate,

• you are legally authorized to enter into these Terms,

• and your use of the platform complies with applicable laws and regulations.

3. User Accounts

You may create an account to:

• book appointments,

• manage salon operations,

• sell products,

• manage marketplace listings,

• or access platform features.

You are responsible for:

• maintaining account security,

• safeguarding your login credentials,

• and all activity under your account.

You may not:

• impersonate another person or business,

• share accounts improperly,

• attempt unauthorized access,

• or misuse the platform.

We may suspend or terminate accounts that violate these Terms.

4. Marketplace Transactions

Nailzy allows independent businesses and brands to sell products through the platform.

Marketplace sellers are solely responsible for:

• product listings,

• pricing,

• inventory,

• fulfillment,

• returns,

• warranties,

• taxes,

• and compliance with applicable laws.

Nailzy is not the manufacturer or seller of third-party products unless explicitly stated.

We may remove listings, suspend sellers, or restrict transactions that violate platform policies.

5. Booking Services

Nailzy provides booking infrastructure for salons and independent nail technicians.

Salons and service providers are independently owned businesses and are solely responsible for:

• services performed,

• scheduling,

• pricing,

• staff conduct,

• licensing,

• sanitation,

• safety,

• cancellations,

• and customer disputes.

Nailzy does not guarantee:

• appointment availability,

• service quality,

• pricing accuracy,

• or outcomes from services booked through the platform.

6. Payments, Deposits & Refunds

Payments may be processed through third-party providers such as Stripe.

Salons may require:

• deposits,

• cancellation fees,

• or prepayments.

Refund and cancellation policies may vary by salon, seller, or transaction type.

Nailzy may facilitate payment processing but is not responsible for:

• bank delays,

• failed transactions,

• chargebacks,

• or disputes between users and salons/sellers.

7. SMS Communications & Appointment Notifications

By providing your phone number and opting in, you consent to receive transactional SMS messages related to your activity on Nailzy.

These messages may include:

• appointment confirmations,

• appointment reminders,

• cancellations,

• reschedules,

• booking updates,

• verification codes,

• and account-related notifications.

Messages may be sent by Nailzy on behalf of participating salons and businesses using automated technology.

Consent to receive SMS messages is not a condition of purchasing products or receiving salon services.

Message frequency varies based on your activity.

Message and data rates may apply.

Reply STOP to opt out.
Reply HELP for assistance.

Nailzy does not use transactional booking SMS consent for unrelated third-party marketing campaigns.

Wireless carriers are not liable for delayed or undelivered messages.

8. User Content

You may submit:

• reviews,

• photos,

• salon content,

• product listings,

• messages,

• and other materials.

You retain ownership of your content, but you grant Nailzy a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content for operating and promoting the platform.

You may not submit content that:

• is unlawful,

• infringing,

• fraudulent,

• abusive,

• sexually explicit,

• defamatory,

• or violates third-party rights.

9. Acceptable Use

You agree not to:

• interfere with platform operations,

• scrape or harvest data,

• distribute malware,

• engage in fraudulent bookings,

• manipulate reviews,

• or misuse the services.

We reserve the right to investigate and restrict activity that harms the platform or other users.

10. Intellectual Property

Nailzy, its branding, software, platform design, logos, and technology are owned by Gloora LLC or its licensors.

You may not:

• copy,

• reproduce,

• distribute,

• reverse engineer,

• or exploit platform materials without written permission.

11. Third-Party Services

Nailzy may integrate with third-party services including:

• Stripe,

• Twilio,

• Google,

• Meta,

• analytics providers,

• and other service providers.

Your use of third-party services may also be governed by their terms and policies.

12. Disclaimers

The platform is provided “as is” and “as available.”

To the fullest extent permitted by law, Nailzy disclaims warranties of:

• merchantability,

• fitness for a particular purpose,

• availability,

• accuracy,

• and non-infringement.

We do not guarantee uninterrupted or error-free operation.

13. Limitation of Liability

To the maximum extent permitted by law, Gloora LLC and Nailzy shall not be liable for:

• indirect damages,

• lost profits,

• lost data,

• service disputes,

• personal injury,

• product defects,

• or business interruption.

Our aggregate liability shall not exceed the greater of:

• the amount you paid to Nailzy in the prior 12 months, or

• $100 USD.

14. Account Suspension & Termination

We may suspend or terminate accounts that:

• violate these Terms,

• create legal or operational risk,

• engage in fraud,

• abuse the platform,

• or harm other users.

You may stop using the platform at any time.

15. Changes to These Terms

We may update these Terms periodically.

Continued use of Nailzy after updates constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
